Terms of Use
Last updated: October 21, 2026
These terms are the agreement between you and Muhammed Zahid Pehlivan, the developer of the NEAT365 iPhone app (the "app"; "we", "us"), for your use of the app. By downloading or using the app, you accept these terms and the Privacy Policy. If you don't accept them, don't use the app.
1. The parties and Apple
- This agreement is between you and us only; Apple Inc. is not a party to it.
- We, not Apple, are responsible for the app and its content.
- These terms may not conflict with the Usage Rules in the App Store Terms of Service; if they do, those rules prevail.
2. Who may use the app
You must be at least 18 years old and able to enter into this agreement to use NEAT365.
3. Licence to use the app
- We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on Apple-branded devices that you own or control, for personal, non-commercial purposes only.
- This licence is subject to the Usage Rules of the App Store. People who access the app through Family Sharing or volume purchasing may also use it.
- You may not rent, sell, distribute or sublicense the app.
- You may not reverse engineer the app, try to obtain its source code, modify it or create derivative works from it, except where applicable law permits this despite these restrictions.
4. The service
NEAT365 is a personal life assistant. It helps you keep track of and plan your steps, sleep, water, nutrition, workouts, fasting, supplements, plans, spending, cycle and body measurements.
We may improve, change or remove features of the app over time.
5. Medical disclaimer
- NEAT365 is not a medical device or a health service. It does not diagnose, treat or prevent any disease.
- The app's measurements, calculations and analyses are estimates: they are not exact and can be wrong. They are based on your phone's sensors, the data that comes from Apple Health and what you enter. For example, sleep stages and snoring are inferred from the sounds your phone picks up, and calorie, water and step goals are calculated with general formulas.
- The app's suggestions, plans, calorie and nutrient estimates, sleep analyses, cycle predictions and the Assistant's answers are general information, not medical advice.
- Cycle predictions must not be used for contraception or to plan a pregnancy.
- Talk to your doctor before you start an exercise or nutrition program, before you change how you take medicines or supplements, and whenever you are pregnant, breastfeeding or have a health condition.
- In an emergency, call your local emergency number (such as 112 or 911) right away.
6. AI features
- The Assistant, "Add with a photo", "Find with AI" and, in some languages, quick log use a third-party AI service: Google LLC's Gemini API. Requests are passed through our server.
- These features only work after you agree. You can withdraw your consent at any time in Profile → AI permissions.
- What is sent is described in the "AI" section of the Privacy Policy.
-
AI can make mistakes:
- Don't make decisions about your health based on its answers and estimates without checking them.
- Calorie, portion and nutrient estimates are approximate.
- Allergen warnings may not catch every allergen.
- You may not use the AI to create unlawful or harmful content, or content that violates the rights of others.
- To prevent abuse, daily use of the AI features is limited.
7. Account
- You can use the app without an account. If you like, you can sign in with Apple, Google or email.
- You are responsible for keeping your account and sign-in method secure.
- You can delete your account at any time with "Delete account" at the bottom of Profile. Your account on our server and your records on this phone are deleted.
8. Premium subscription
The app's core features are free. Some features, and use and record counts beyond the free plan's limits, require a NEAT365 Premium subscription. The purchase screen lists what Premium includes.
- Plans and prices: Premium is offered with monthly and yearly plans. The price, period and currency are shown on the App Store purchase screen before you buy, and may differ by country.
- Payment: Payment is charged to your Apple Account when you confirm the purchase. Apple takes the payment; your payment details never reach us.
- Automatic renewal: The subscription renews automatically for the same period and price unless it is cancelled at least 24 hours before the end of the current period. The renewal is charged to your Apple Account within the last 24 hours of the period.
-
Free trial: Some plans may offer a free trial; its length and who can use it are shown on the purchase screen.
- Unless you cancel at least 24 hours before the trial ends, it turns into a paid subscription.
- Any unused part of a trial ends when you buy a subscription.
-
Managing and cancelling:
- You can manage or cancel your subscription in your phone's Settings → [your name] → Subscriptions.
- Cancellation takes effect at the end of the current period, and you keep Premium until then.
- Deleting the app or your account does not cancel your subscription.
- Refunds: Apple handles refund requests under its own rules: reportaproblem.apple.com. This doesn't affect your rights under applicable consumer law.
- Price changes: If the subscription price changes, Apple will tell you in advance and ask for your consent where required.
- Restoring purchases: With the same Apple Account, you can bring Premium back on another device, or after reinstalling the app, with "Restore purchases".
- When Premium ends: Your records are not deleted. You just can't use the Premium features or add new records beyond the free plan's limits.
9. Data and backups
- Your records are stored on your phone. If your phone is lost or broken, or the app is deleted, your records can't be recovered without a backup.
- You are responsible for creating encrypted backups with "Back up" and for keeping the backup file.
- We don't know your backup's password; if you forget it, we can't open the backup.
- How your data is processed is described in the Privacy Policy.
10. Acceptable use
You may not:
- try to disrupt or overload the app or our server, or get around its security measures;
- use automated tools (bots) to get around usage limits;
- use another person's account or data without permission;
- use the app for an unlawful purpose or in a way that violates the rights of others.
If you break these terms, we may stop your access to the app's server features.
11. Intellectual property
- The app, including its design, texts, drawings, logo and code, belongs to us or our licensors. These terms only give you the licence in section 3.
- Move animations and instructions: licensed from WorkoutX.
- Barcode data: comes from Open Food Facts (Open Database License).
- Weather: comes from Open-Meteo (CC BY 4.0).
- The attributions for these sources are in the app, under Profile → About.
12. Third-party services
The app uses services of third parties such as Apple, Google, RevenueCat, Open-Meteo, Open Food Facts and WorkoutX. These services are subject to their own terms. To the extent the law allows, we are not responsible for problems caused by a third-party service being interrupted or changed.
When you use the app, you must also comply with the terms of the services you use (for example, your mobile data or internet provider).
13. Maintenance and support
- We alone are responsible for maintaining and supporting the app. For support: [email protected]
- Apple has no obligation to provide any maintenance or support services for the app.
14. Warranty
- The app is provided "as is" and "as available".
- To the extent the law allows, we give no express or implied warranty that the app will work without interruption or errors, or that it will suit any particular purpose. Any warranties that applicable law gives you are not affected.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) you paid for the app.
- To the maximum extent the law allows, Apple has no other warranty obligation with respect to the app. Any claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are our responsibility, not Apple's.
15. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental or consequential damages, or for loss of profits or data, arising from the use of, or inability to use, the app. Our total liability is limited to the amount you paid for the app in the last 12 months.
These limitations don't apply to damage caused intentionally or through gross negligence, to injury to life, body or health, or where applicable consumer law doesn't allow them.
16. Product claims
We, not Apple, are responsible for addressing any claims relating to the app or your use of it. These include, but are not limited to:
- product liability claims;
- any claim that the app fails to conform to any applicable legal or regulatory requirement;
- claims arising under consumer protection, privacy or similar legislation, including in connection with the app's use of Apple Health (HealthKit).
17. Intellectual property claims
If a third party claims that the app, or your use of it, infringes its intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
18. Legal compliance
You represent and warrant that:
- you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country;
- you are not listed on any U.S. Government list of prohibited or restricted parties.
19. Termination
- You can end this agreement at any time by deleting the app and cancelling your subscription.
- Your licence ends automatically if you break these terms.
- Provisions that by their nature should survive termination (in particular sections 11, 14, 15, 16 and 21) remain in effect.
20. Changes
We may update these terms. Before an important change, we'll let you know in the app and on neat365.net. If you keep using the app after a change, you accept the new terms.
21. Governing law
- These terms are governed by the laws of the Republic of Türkiye.
- Any rights that the laws of your country of residence give you as a consumer, and that can't be waived by contract, are not affected. This includes your right to go to the courts and consumer dispute bodies where you live.
22. Third-party beneficiary
Apple and its subsidiaries are third-party beneficiaries of this agreement. When you accept these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
